We are not responsible in case of any consequences that are faced due to use of these materials. In this situation, we reserve complete authority to provide your information upon request to any legal representative or authority.

Refunds wihin 30 days in any situation will not include 3rd Party software Charges such as cPanel / Plesk Charges. i.e. you are only liable to receive refund for the hosting package and not for the control panel as this is charged to us by the software company itself. The non-refundable's include cPanel VPS / Dedicated Server License, Dedicated Server, Plesk, HostingController, Virtuozzo, SSL Certificates and Site Builder.

Requests for cancellation must be submitted through our helpdesk at http://support.bodhost.com under the “Dedicated Server Support” section. A 30 (thirty day) notice has to be given if the client wishes to cancel their services. This notice has to be given from the registered email address for the hosting account in BODhost.Upgradation records. If, in any case, the client does not give a 30 day notice, the next renewal will be charged to the customer's account.

Performance Credit ("Performance Credit") occurs when 100% uptime is not met. BODhost will refund the customer 5% of the monthly fee for each 30 minutes of downtime (up to 100% of the customer's monthly fee). Network downtime is measured from the time a trouble ticket is opened by a customer to the time the server is once again able to transmit and receive data.

Appropriate reason should be provided in order to claim refunds from bodhost.com. If in case, you fail to do so. We reserve the rights to refuse / cancel or suspend service to your account. If the cancellation request is received within six to zero days before the renewal date, this cancellation request will be effective on the following billing cycle and charges for the current month will apply.

Any payments through e-check will take upto five days to clear. Following there will be a verification process to confirm the genuinity of the customer and thereafter the account information will be provided to you.

You shall not engage in any unsolicited email practices at any domain hosted in our server or parked on our DNS servers. You are NOT allowed to use the services for chain letter, junk mail, spamming, or any other use of distribution list to any person who has not given permission to be included in such of process. Use the SMTP services of a third party for the purposes of relaying or sending electronic mail messages without the express permission of that third party.

Host a publicly-accessible "open relay" SMTP or anonymous remailer service for any purpose, cause, or reason.

Use the Service in violation or contravention of the Communications Act of 1934, as amended by the Telecommunications Act of 1996, or any other applicable law, regulation, order or other governmental directive, or abuse or fraudulently use the Service in any way not specifically set forth above.

If customer is notified by BODHost.com's Abuse Response Team, via e-mail or the Customer discovers on their own or through any other means, that the Customer themselves or any third party under Customers control of a violation of this AUP, the Customer will take whatever steps are necessary to stop such activity, and prevent repeat violations by the offending entity. If not, BODHost.com is entitled to suspend/terminate the customers account immediately.

Server abuse in any situation is not allowed. If any threats are shown for this record. The hosting account will be suspended or terminated without any refund. You are NOT allowed to use this server's disk space nor it's bandwidth to distribute, electronically transmit or display any materials which: violate any countries laws or regulations; infringe on any intellectual property rights (e.g. copyright, trademark, patent or other proprietary rights); are threatening or harassing; are discriminatory based on gender, race and/or age; are consist of any viruses or other computer programming defects which result in damage to our server or any third party.

The customer will respond to all violations reported within 1 (one) business day of the violation being reported, and will have put a stop to the activity within 2 (two) business days of the violation first being reported.

Any interference with other's services, host or network is strictly prohibited. Users who violate systems or network security may incur criminal or civil liability.

Any information that is provided through BODHOST through any communicational means not to raise any disputes against www.bodhost.com nor do he /she initiate any legal proceedings with respect to the same.
